Trademarks

Registration is required to establish rights in a trademark; Bulgaria is a "first to file" jurisdiction. Use of an unregistered mark for any goods or services is legal, but it is not recommended.

Another way to protect your trademark in Bulgaria is to apply for Trademark in European Union (EUITM). EUITM r give protection in all Member States of the European Union (currently 27 Member States), including Bulgaria.

Validation EP in Bulgaria

The European patent is issued by the European Patent Office. Once a notice of the grant of a European patent has been published in the European Patent Bulletin, the European patent must be validated in each of the selected countries previously mentioned within a specified period in order to maintain the protection on the territory of the country concerned and the patent law to be applicable against infringers.

The deadline for validation in Bulgaria is 3 months from the mention of grant. This term is not extendable.
